The High Court for the whole of Gujarat. It hears bail matters, quashing petitions, writ petitions, criminal and civil appeals and revisions, and appeals from Family Courts.

Matters commonly taken to the High Court

  • Anticipatory bail and regular bail: under sections 482 and 483 of the BNSS, the High Court and the Sessions Court both have power to grant bail. In practice the Sessions Court is usually approached first.
  • Quashing of FIRs and criminal proceedings under section 528 of the BNSS (formerly section 482 CrPC), for example where the allegations do not disclose an offence or the parties have settled a dispute that is essentially private.
  • Writ petitions under Article 226 against the State, its authorities and public bodies, and petitions under Article 227 over subordinate courts.
  • Appeals and revisions in criminal and civil matters, and appeals against Family Court decisions under section 19 of the Family Courts Act, 1984.

From the trial court to the High Court

Many High Court matters begin in a district court in Vadodara, Bharuch, Ahmedabad or elsewhere in Gujarat. When the same advocate has handled the trial court stage, the record and the history of the case are already known, which helps in preparing the High Court petition or appeal.

Time limits

Appeals and revisions are subject to limitation periods that start from the date of the order under challenge. Certified copies of the order and the record should be applied for promptly.
