Read it carefully, note the date you received it and any deadline it mentions, and keep the envelope or email. Do not ignore it, and do not reply in anger. Collect the documents that relate to the claim and take legal advice before replying, because what you say in a reply can be used later in court.
What is a legal notice?
It is a formal written communication stating a claim or grievance and what the sender wants you to do. In some cases a notice is required by law before proceedings can be started, for example the demand notice in a cheque dishonour case or a notice to quit in some tenancy matters.
Why the date matters
Some notices start a legal clock. A cheque bounce demand notice gives the drawer 15 days to pay before the offence is complete. Keeping proof of the date you received the notice is important.
How to respond
- Check whether the facts stated are accurate
- Gather agreements, receipts, messages and correspondence
- Have a reply drafted that addresses the allegations without unnecessary admissions
- Send the reply by a method that gives proof of delivery
- Keep copies of everything
Is a reply compulsory?
There is usually no legal obligation to reply, but an unanswered notice can be presented as acceptance of the allegations, and a well-drafted reply records your position early.
Can the matter be settled?
Often, yes. A notice is frequently the first step in negotiation. Settlement terms should be recorded in writing.
